1. Our Agreement with You
1.1. As a customer of Tiny Toes Ballet Pty Ltd (TTB) these terms and conditions form the basis of your agreement with TTB.
1.2. TTB reserves the right to update these terms and conditions at any time without prior notification to enrolled families. Your continued enrolment in TTB is subject to acceptance of our updated terms and conditions.
2. How to Apply and Make a Payment
2.1. New families may register for a trial lesson via phone or online at www.tinytoesballet.com.au.
2.2. After the trial lesson, TTB will hold a place in the class trialled at for 48 hours. To secure a position in the class you trialled at, families must provide payment details (Mastercard or Visa) to TTB via phone or via TTB’s Parent Portal within 48 hours. TTB will then take payment for the trial lesson and for the remainder of the term. If you attend the trial lesson and decide not to continue, then you will not be charged for that lesson.
2.3. For enrolled families a valid credit/debit card number will be required in our parent portal as payment for each term will be taken up to two weeks in advance by direct debit (Mastercard or Visa). TTB does not accept cash, cheques or bank transfers as payment methods. Direct debit dates will be listed in our newsletters in advance, alternatively, email accounts@tinytoesballet.com.au. If payment bounces on the direct debit date, the affected account will receive an email and will have 24 hours to update the Parent Portal with new payment details. An administration fee of $15 will be added to any payment which is overdue. Failure to pay on the direct debit date may result in removal from the selected class.
2.4. Under our refund and credit policy, fees are payable by the term in advance and there is no refund or credit given for classes that are missed or for change of mind.
2.5. Current students who wish to withdraw from Tiny Toes Ballet must do so via the Class Cancellation Request form available when accessing the Parent Portal. To ensure that you are not billed for the following term, class cancellation requests must be submitted prior to the first Wednesday after the term concludes. If you withdraw from a class after the direct debit date but before the start of the following term, we may, at our discretion, refund the fees paid minus a $30 administration fee (credit card surcharges will not be refunded).
2.6. When you enrol at TTB, you are enrolling for the entire calendar year. Fees for the following term will be taken in advance by direct debit (Mastercard or Visa). There is a minimum enrolment period of one term and should you wish to opt out, you must do so via the Class Cancellation Request from available when accessing the Parent Portal. This form must be submitted prior to the first Wednesday after the term concludes. Payrix Australia, who process payments on behalf of TTB will take out, in addition to TTB fees, a 1.98% credit card/debit card surcharge and a 66 cent flat fee. This payment remains with Payrix Australia and TTB does not retain this additional fee.
2.7. TTB will allow students two make-up lessons per term for missed classes (in any equivalent class). Make-up classes can only be done in the same term (subject to class availability and not in the last week of a term) and a time and date must be arranged via the Parent Portal in advance. This applies to face-to-face classes only.
2.8. A “Ballet Classes Online” subscription is a minimum one month commitment. You will be billed on a pro-rata basis if you join before the direct debit date. Until cancellation is received, your credit card (Mastercard or Visa) will continue to be billed every month on the direct debit date. Cancellation of the following month’s subscription must be received in writing at least two business days prior to the direct debit date. Cancellations can be emailed to accounts@tinytoesballet.com.au. TTB does not accept cash, cheques or bank transfers as payment methods. For direct debit dates, please email accounts@tinytoesballet.com.au. If payment bounces on the direct debit date, the affected account will receive an email and will have 24 hours to update the Parent Portal with new payment details. An administration fee of $15 will be added to any payment which is overdue. Failure to pay on the direct debit date may result in removal from “Ballet Classes Online”.
3. Class Procedure
3.1. Children must be taken to the toilet immediately before class starts to avoid unnecessary disruptions during class.
3.2. To enrol in a Preschool Ballet class, your child needs to be toilet trained, separate well from their carer and can follow instructions. If not, the Dance With Me class is suggested.
3.3. Ensure that your child arrives on time for every class and is in the presence of a teacher when you or the child’s guardian drops them off.
3.4. TTB provides supervision of young people during class hours only.
3.5. In order to maintain a positive and controlled environment during the term our classes are generally closed to visitors. The very last class of every term will be open for viewing by friends and family and where a child is particularly sensitive it may be possible to arrange for the first two classes to be attended by a parent or guardian. All parents are welcome to attend their child’s first trial lesson.
3.6. All students are to wear appropriate footwear for safe dance practice. TTB does not allow socks, stockings or jiffies because they are too slippery.
3.7. Food and drinks must not be brought into the studio. It is acceptable to bring water in a suitable bottle.
3.8. If you are participating in a “Dance with Me” class you must turn your mobile phone off so that it will not disrupt the class.
4. Costs
4.1. In the final lesson of Term 4, all students will participate in a performance during their child’s usual class time, where family and friends are welcome to come and watch. This will incur additional charges which will be debited from the card on the Parent Portal in Term 3. Please feel free to contact our office about what to expect financially for the additional charges. By enrolling in Term 4, you confirm that you agree to pay the price set by TTB for these items.
4.2. If your child is unable to participate in the concert and there are concert items that you have paid for, you may have these posted to you at an additional charge after the concert.
4.3. TTB reserves the right to make amendments to the timetable, location, price structure and teachers at any point in time. Credits or refunds will not be offered due to a timetable change, teacher change or location change.
4.4. TTB fee structure is based on a term made up of between 8 and 11 classes (depending on the length of the term). We do offer a trial lesson for new students who have not been previously enrolled with us.

4.8. Non-Attendance – If your child has been absent for two (2) consecutive lessons without contact, their position in class will be automatically released unless having made prior arrangements with TTB.
4.9. Students with outstanding amounts on their account may be excluded from classes until their fees have been brought up to date. No student will be permitted to dance in the end of year concert whilst they have outstanding fees.
4.10. Acceptance of and continued enrolment is at the sole discretion of TTB.
5. Communication
5.1. TTB will communicate primarily by email. TTB will not provide your details to any other company, entity or organization without your prior consent and all information will be kept by TTB in accordance with The Privacy Act.
5.2. TTB will endeavour to ensure that all communications are virus free, however, TTB is not responsible for any loss of damage suffered by you in the event that a virus or like issue is transmitted unknowingly by TTB. You cannot unsubscribe from emails if you are currently enrolled in a TTB class.
6. Staff
6.1. The teachers are all highly skilled dance professionals. All staff, contractors, sub-contractors or directors of TTB have a working with children certificate as required by relevant legislation with the NSW Office of Communities.
7. Media and Publicity
7.1. TTB may take and use photographs and videos of class participants for promotional and archival purposes only.
7.2. All material recorded during any class is the copyright of TTB.
7.3. At the end of each term you are invited to watch your child’s dance class. We are happy to agree for you to take photos or videos of your child during the last class of each term.
7.4. All employees, contractors, sub-contractors or directors of TTB are on advice to decline all social media invitations from students and parents.
8. Social Media and Release of Liability
8.1 By enrolling your child into any of our classes at TTB regardless of whether these terms and conditions have been signed, you hereby provide your express consent for our team to photograph and take video of your child/ren and provide your consent and release for our team to upload such images/videos on our social media pages including but not limited to TikTok, Facebook, Instagram and our website.
8.2 You hereby acknowledge that parents have been requested by TTB to only photograph and video their own child. You acknowledge that this is not something that can be actively monitored by TTB. It is up to the individual parents to abide by this policy and you hereby release TTB of any liability and indemnify TTB of any liability concerning the photography, videography, and/or sharing of such images and videos recorded by third parties.
8.3 You hereby release and indemnify TTB of any liability associated with the filming, photography and or videography of your child whilst attending any of our TTB classes, special days, competitions and/or events and provide your express consent for videos and photos to be taken of your children on these occasions.
8.4 You acknowledge and provide your consent to upload and use any videos and photos taken of your child whilst enrolled at TTB, to be used in any promotional marketing for TTB.
9. Recording of Classes and Intellectual Property
9.1. The TTB Syllabus is the Intellectual property of Tiny Toes Ballet Pty Ltd.
9.2. You hereby agree not to record any of the TTB classes, and or Syllabus and acknowledge that by doing so you are infringing on the intellectual property of TTB.
9.3. All content provided by Tiny Toes Ballet Pty Ltd in connection with this agreement are protected under copyright law. Unless authorised by us in writing you must not reproduce or distribute in any form whether or not for commercial purposes any part of the TTB syllabus.
9.4. You hereby agree not to duplicate/copy in any way shape or form any content disseminated and published by Tiny Toes Ballet Pty Ltd.
10. Consent and Release
10.1. Dance is a physical activity and the teacher or teaching assistant may have to assist your child’s understanding of an action, posture or position by using physical contact e.g. holding hands in a circle, lifting and correcting posture. You consent to employees, sub-contractors, contractors and directors of TTB having contact with your child in this regard.
10.2. You consent to employees, sub-contractors, contractors and directors of TTB taking your child to the toilet during class if required. The children must be independently able to use the toilet; the staff will call you if any further assistance is required. If your child needs to go to the toilet during class time and you or your child’s guardian is not present on the premises, please be aware that we may ask another parent to assist your child.
10.3. Should your child hurt his/herself you consent to employees, sub-contractors, contractors and directors of TTB to attend to your child whilst waiting for the nominated guardian to take over.
10.4. In booking into a class with TTB, participants or their parents acknowledge that activities are physical and may involve the risk of accidents occurring.
10.5. Participants or parents must advise TTB in advance of any class if they or their child has health problems and/or requires medication while attending a class. TTB teachers take care of children during their classes but cannot be responsible for the administration of medication or ensuring suitable health precautions are in place to suit all participants.
11. Code of Conduct
11.1. Honesty and integrity is expected.
11.2. Students and parents must demonstrate respect for all students, faculty, staff and other parents at all times. If disrespect is shown, the family may be asked to leave.
11.3. No bullying or gossip will be tolerated.
11.4. Respect and care must be shown to all equipment, facilities and property.
11.5. TTB reserves the right to ask any family to leave the school for inappropriate behaviour.
12. Subscription Ballet Classes Online
12.1. Online classes refers to both pre-recorded classes and live, streamed classes.
12.2. Before participating, please consider if you have enough clear space, that is free of obstacles and suitable to work in safely; that the floor surface is suitable to work on; and that you have footwear appropriate for that surface. Please warm-up and cool down appropriately (before and after the session) and do feel free to stop and/or modify activities as necessary.
12.3. Any child participating in an online class must have a suitable parent/guardian present to participate in this activity. Given the nature of these activities, you participate at your own risk and should only do those activities that you consider safe for your own body and the space that you are working in.
12.4. Please note that parents are bound by the Australian Copyright Regulations regarding recording, both video and audio, of their children’s TTB online class. Anything contained in a TTB online class must not be reproduced in any form. This is strictly prohibited by Australian Copyright Law and can result in large Government fines being imposed.
12.5. Once access to TTB’s online ballet classes has been granted, no refunds or credits will be allowed under any circumstances.
13. General
13.1. This agreement is governed by the laws of New South Wales, Australia and the parties irrevocably and unconditionally submit to the non-exclusive jurisdiction of the courts of New South Wales, Australia.
13.2. Any modification to or variation of this agreement must be in writing and signed by both parties.
13.3. A waiver of any provision of or right under this agreement must be in writing signed by the party entitled to the benefit of that provision or right and is effective only to the extent set out in any written waiver.
13.4. Each party must use reasonable efforts to do all things necessary or desirable to give full effect to this agreement.
Please read this document carefully and thoroughly.
Enrolling in our classes regardless of whether these terms and conditions are signed, expressly confirms your acceptance of all clauses in these terms and conditions document including release of liability of Tiny Toes Ballet and its employees, contractors, sub-contractors and directors for any and all injuries caused by participation in a class or the activities of ballet, creative movement and dance whether or not such injury was caused by alleged negligence.
